Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") form a binding agreement between you and R&D STREAMS ("R&D STREAMS", "we", "us", "our"), the operator of the Toss Sense service ("Service"). By creating an account or using the Service, you accept these Terms.

2. The Service

Toss Sense is a coin-toss prediction game with preset rooms, custom rooms (Pro), and district leaderboards. Features may evolve over time.

3. Eligibility and account

You must be of legal age in your jurisdiction (or have appropriate authority to bind your organisation) to use the Service. You are responsible for keeping your credentials confidential and for all activity under your account. Information you provide must be accurate and kept up to date.

4. Acceptable use

You agree not to misuse the Service, including by:

• using it for unlawful, fraudulent, or deceptive purposes;
• sending spam or attempting to game leaderboards through automation, multiple accounts, or collusion;
• infringing intellectual property or other rights;
• interfering with security (probing, scanning, malware, scraping, circumventing rate limits or technical controls).

5. Intellectual property

R&D STREAMS retains all rights, title, and interest in the Service, including software, documentation, branding, and content we provide. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You may not reverse engineer, resell, or redistribute the Service, or circumvent its technical limits.

6. User content

You retain rights to content you submit. You grant us a limited license to host and process that content solely to provide the Service.

7. Payments and subscriptions — Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically until cancelled. You can manage and cancel your subscription via the customer portal linked from your profile or via paddle.net.

8. Service level and warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee that it will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Liability

To the maximum extent permitted by law, our aggregate liability is capped at the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted.

10. Suspension and termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your data after a reasonable export window where applicable.

11. Indemnity

You agree to indemnify R&D STREAMS against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which R&D STREAMS is established, without regard to conflict of laws rules. Disputes will be resolved by the competent courts of that jurisdiction, unless mandatory consumer law provides otherwise.

13. Changes

We may update these Terms. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.
